Suit Filed Against The Internet Archive

According to this NY Times article, a Philadelphia healthcare company is suing a law firm and the Internet Archive doesn't archive all websites and follows standard webcrawler protocol by reading a "robots.txt" file that can be placed in the root directory of any site. Healthcare Advocates did just that to prevent public access to their archives, but apparently Harding Earley, the law firm in question, hammered the Internet Archive has breached their contract and is accused of negligence as well.

It's kind of sad really. I mean, for starters: why is personal, medical information put up into an online archive to begin with? Well, there's the obvious answer that hospitals need to be able to share information, but beyond that, why isn't that information, you know, secured the right way? Robots.txt only goes so far in preventing crawlers because if the data isn't secure enough in the first place, what's to stop some jackass from taking a copy of the whole server with BlackWidow or another crawler?

This is some serious BS in terms of keeping data safe versus copyrights. But then again, stranger things have happened I suppose, while it might not be a bot error, it may be a human one. Time will tell.

I love the Wayback Machine. And um ya... there is no way they can win that suit. The files were once open to the public. Any plain Joe could have gone to the site and saved the website files for viewing later on. It really looks as though they have no argument at all here.
