BandMerch Frequently Asked Questions

$Moonbeam13:iconMoonbeam13: reports, September 29, 2005
BandMerch FAQ

« Visit the deviantART and BandMerch Portal

  1. What format should I submit?

You should submit .jpg images but if your design is selected you will be required to provide a .psd or .eps file.

  2. What am I designing for?

    You are designing for t-shirts.

  3. What are the bands currently working on?

Please visit BandMerch. On the side bar to your left you will see links for current promotions, band tours and band news. You can also check the official band websites for more information.

  4. What dpi should I submit?

If your design is chosen, final artwork is required at 300dpi.

  5. Who chose the price range and is there a reason there is a predetermined price?

The price range is the range that is typical for BandMerch. They just don't pay more than that for a design. The purpose was to set an expectation of what BandMerch was committing to with the community as they didn't want to mislead people to thinking there was a chance that they would be paying higher rates.

  6. Can I use copyrighted logos for the band in my design?

Yes, this is allowed but not required.

  7. What is deviantART’s cut of the money?

deviantART makes no money from this agreement with BandMerch. All we stand to gain is some exposure.

  8. What is the BandMerch submission agreement?

You can read the agreement here (PDF). Should you sign the agreement with BandMerch you will be entering into a contract with them and not deviantART. Therefore any questions concerning the agreement should be directed to deviantinquiries@bandmerch.com.

Please do NOT forward these questions to the deviantART helpdesk.

  9. Do I retain rights to my artwork when I submit to the Community Marketplace?

Rights to your artwork are yours unless your design is chosen by BandMerch and you sign their submission agreement and receive payment. At that time the design becomes the property of BandMerch.

  10. How do I get credit for my work?

You will be credited on the BandMerch website by your design. "A new design by (artist name) for (band name)" and a link back to your deviantART webpage will be available.

  11. If my work is selected can I keep it on deviantART?

Yes, you are allowed to keep your selected work as part of your deviantART portfolio. However, if you have it set up as a print offering that will have to be disabled as the design will now belong to BandMerch.

  12. Where is the forum?

The forum can be found on the Community Marketplace page at marketplace.deviantart.com

  13. What is Spec work and what are the pros and cons?

Essentially, spec work is marketing but with a specific project attached, a logo or commercial campaign and often, at the request of someone else, an agency or specific client.

    Pros:
There are lots of reasons to work on spec and not all of them will be covered here. Whatever your reason, it’s important to have it clearly in mind, to know what you’re gaining and why. Then, you can protect that “alternative payment” along the way.
Four of the more common reasons to work on spec are to build a reputation, form relationships, raise awareness for an idea, and to land a paid project.

    Reputation
Spec work is of particular use to fresh talent and new groups, looking to build a reputation. It goes without saying; you need to show work to get work. You need a portfolio, a track record. Whether you’re a new, cutting-edge designer or the star graduate, a track record not only proves your skills; it builds confidence in your ability to deliver.

The right spec job allows aspiring professionals to build that track record. It’s one thing to do something for yourself, on your own time. It’s quite another to be part of a larger project, with other people and other priorities. Choosing the right spec opportunity can be a fast track to the kind of reputation you’ll need to get paid work.

A portfolio is often not enough, especially if it’s filled with all your own projects and ideas. The good thing about spec work is once it’s done; no one’s going to ask later how much you got paid. As far as anyone is concerned, it was a professional job with professional results.

"Working on spec is often the best work, the best opportunity to create what you really want to create."

The key here is to find the right project. Find something you respect. Meet the right people. Get them excited. And make it happen.

Just be sure to keep your reasons in mind. If reputation and experience is your goal, it is essential to define your rights to use work on your design and to get credit for what you’ve done. It shouldn’t be difficult to make that clear but it’s important to do so.

    Cons:

Working on spec is taking on a design project, doing the preliminary work (and perhaps even a finished product) without a contract, without a deposit, and with nothing more than a hope that the prospect will like the work enough to pay for it.

The danger is that the client will either not like the work or balk at the suggested payment leaving the designer with several hours of unpaid work or that the client will like the work but will simply take it without paying for it.

(With the bandmerch deal the payment is already put out there and the work remains yours unless it is chosen by BandMerch and you subsequently sign the submission agreement.)

BAD BAD BAD!

# 8 Do I retain rights to my artwork when I submit to the Community Marketplace?

Rights to your artwork are yours unless your design is chosen by BandMerch and you sign their submission agreement and receive payment. At that time the design becomes the property of BandMerch.

An artist should NEVER sell all rights. A total buyout at this kind of price UNDERVALUES YOUR artwork and HURTS other artists in the process! You are basically committing art suicide by doing this. Artists who are serious about their art generally make MUCH more than this when a buyout of ALL rights is done. I refer you all over to GAG The Graphic Artist's Guild for standards on this. The contract monitor can be found here on their site with examples. If any of you have any questions I would say email GAG as they are VERY friendly. If the artist is chosen, you can  your © adios from the way it looks.

# 13 What is Spec work and what are the pros and cons?

Spec work, the sweatshop of art. No one does spec work, it's flat out unethical. Again it undervalues your work as an artist. If someone likes your work they should hire you straight away based on your abilities and talent. When you walk into a doctors office, do they do spec work....I wish! When you go to dinner, do you eat on spec? I wish! Spec work is BAD.....flat out BAD and VERY unprofessional.

I refer you ALL over to this article about GAG and Contests posted on Creative Latitude [link] I also URGE you ALL to read it if you are seriously considering entering this.

Some highlights from the article:

The similarity to speculative design work is blatant in many of these “competitions.” (A great piece about dealing with “spec” work situations can be found on Creative Latitude). Designers are being asked to create work for the chance that their work might be selected or used by the client. In these cases the carrot being dangled is often a prize of significantly less value than the designer could earn if contracted directly to produce the work. Instead of committing themselves and contracting with one design professional, the business or organization in question is setting up a veritable smorgasbord of creative possibilities for themselves, with little consideration for the individual designer or the value of their time and talents.

In all cases, the Graphic Artists Guild (GAG) suggests that those conducting competitions initially review existing work of designers or artists, rather than requiring the execution of newly created, speculative work. Through a process of elimination, finalists are then asked to possibly submit rough sketches prior to being named the finalist for the project contract. A number of guideline recommendations then help the event sponsor select a final art piece or design. The organization also stresses that any prize awarded should be commensurate with the fair market value of the work being done. GAG also recommends that the individual creating the work should retain a variety of rights for the work done.

KK you speak the truth.. this is a poor attempt at waylaying the band-merch crtisims.. but i was very surprised to here bandmerch would not normallty pay other designers more than this.. infact i suppose they must just have internal designers on a salary.

I know....very depressing. Honestly let's look at the facts. I did a CD cover a couple years ago that took me about 20 hrs....I was compensated for all the time I spent, I did 3 revisions, the entire layout in Quark, back, frt, inside with 5 pages, cd design itself. I was paid 1500- straight accross and still own my rights to the cover. And this IS an INDY label! Known to pay less than major labels. I just get sick of people not knowing what's up and thinkin "OMG! The bands! I love them! I would even do it for free! Great expsoure!" ~BUZZ~!!!! Wrong. While the exposure may be great, it is people like this that undermind and undervalue our industry as a whole. Spec work is bullshit, straight accross. Its up there with Work for Hire IMO. It's a way for companies to take advantage of artist's and get stuff on the fly for next to nothing. U like my work, fine., Hire me based on my EXISTING images, my portfolio, don't ask me to do ya full on artwork and NOT expect to compensate me. be professional, get a contract,.....aqnd hire me on my talent. Not "call for entries with spec cuz Blink182 wants too BS and they are a big band and blah blah blah" yeah so big that they can't afford to actually HIRE someone from DA to do a cover? How about a call for entries based on EXISTING artwork people already have here? Hmmm wow a thought! Instead of the not in the know kid who is gonna spend 15 hrs on a cd cover and make jack shit fdr it when he could be sellin it!?!?!?
This is a topic I feel VERY strongly about. I didn't spend over 50k on a BFA in illustration and minors in GD and FA to do damned spec work. People will jump at this I know...but it's sad....it's amazing how many are really uneducated about the industry as a whole and how people WILL take advantage of you if u let em..../end rant
