RIPPED ART AGAIN-THIS TIME IT IS A DA FREE-FOR-ALL

`DWALKER1047:iconDWALKER1047: reports, July 6, 2007
DA FREE-ART-FOR-ALL

We have good and bad news. The bad news was that there was.....ANOTHER RIP!!! The good news.....the person doing the ripping was forced to take down the site!

This time it included nearly 8,000 images from DA, by the admission of the person who stole the images. This admission was emailed to another DA member from the owner of the site.....who admitted to stealing the 8,000 DA images from DA members.....to plaster as wallpaper offerings on his site, FRESH-PAPER.com.

The art work from DA artists was posted as free downloads and credit was not given to the artists who created the works, nor was permission to display their art given!!!

Art was ripped from 59 known DA artists that we had the time to identify.....59!!!

I had asked some of my friends to assist me in identifying the STOLEN ARTWORK, but we were only able to identify a small portion of the art of DA artists...there were many...before the site was shut down and dismantled this morning, July 7th...within 24 hours of our bombarding them with strongly worded email, threats of legal action, and statements that it “WAS NOT OK,” and demands of removal of the art work! Good Job Everyone!!!

Artists so far whose pieces were recognized on this site:

vulcania, silwenka, dwalker1047, Platinus, DragonWinter, nmsmith, Lilyas, bumpyduey, JoelFaber, MichaelFaber, lgmac, Scott5353, Cgx1, Silverb, Gibson125, altergromit, teddybearcholla, lgmac, lyastri, Sya, MichaelFaber, easynow-fractals, judazfx, 0encrypted0, seventotheseven, ninthtaboo, disavian, volantknave, ultimatesensefan, aeires, love1008, thedarkenednight, dreamspeak, nestalgica, marsille, suirebit, L33tM0b1l3, twodimensions, caspernium, lilyas, tokenart, platinus, onebadpenny, steell, droz928, unafraidsage, 1arcticfox, Thelma1, Patrx, magaman, dean-Mcdonald, anjaleck, milleniumsentry, hyruwen, ad245, vladstudio, bsign, and, Zueuk.

Some of the pieces that were stolen were from some of the very popular artist’s here at DA. I am posting what we were able to gather together before the site was dismantled. Please note that we did not have sufficient opportunity to identify all of the pieces, but we made a really big effort nonetheless. There were several deviants who had more than one image stolen.....

Stolen Pieces we were able to identify:

What I have not posted here were the images of at least 200 other artworks we recognized from other artist’s. For those artist’s who are offended by art theft, or who do not want to be ripped, the watermarking idea and protecting your work looks a little bit more important does it not????

Some say that they do not care, but.....a very large portion of this community does care. We care a lot.....and care enough to band together and make these offenders remove the art of our hard work! We gave no permission for the use of our art and received no credit for creating it.

DA’s policies do not include defending artists who have had their art ripped or stolen, but as a community we can unite and do something about it. For those people who want to criticize, please know that we have read the submission policy and we include this here for your convenience:

Please note that the following comes from the journal of :icon1arcticfox:
DOES DEVIANTART OWN MY ART?

"The Submission Agreement explicitly states that you, as the original artist, retain any and all rights appropriate to your artwork at all times. These rights include, but are not limited to, the full and exclusive copyrights to your original artwork. By agreeing to the Submission Agreement what you are really doing is granting deviantART the basic permissions we need in order to display, showcase, and make your artwork available to viewers using the various on-site systems and tools.

At no time do you lose ownership or any of the exclusive copyrights granted to you by law on any deviation or scrapbook submission which you make to deviantART

DeviantART will not use your work for any project without first consulting you and obtaining your consent."

FROM deviantART FAQ POLICIES:

Can I just take deviantART submissions and use them elsewhere?

All original submissions to deviantART are considered the copyrighted property of the submitting artist.

If you desire to use, repost, or otherwise redistribute a deviantART submission you will need to contact each individual artist and obtain a legal license or other permission to use their property.

Please do not contact deviantART directly for this legal license as we do not have the ability to grant such a permission.

Some submissions may be governed by a Creative Commons license which grants permissions under certain conditions. These submissions are specially marked.

Some users may have enabled the use or our Embed or Blog This features which function as a controlled means of displaying their work without needing to directly contact them. These features are explained elsewhere in this FAQ.

*MouseRunner* discovered this article about DA and Art Theft in Plagiarism Today. If you have not read it, please do, it is very interesting and informative--- [link]

Finally, I would like to give a really big THANK YOU to all my friends who had a part in helping to get this thief to take down his site! HURRAY!!!!!

Deb, you're the best! Thanks for writing this! It is sad that we have to go to such lengths to protect our work! As I said, I'm watermarking my work from now on. Thanks for spreading the word for all of us!!
