Ya, ya, I know. Gee another "Orphaned Works" copyright whine post. WRONG.

I've read enough journals with "Theft Being Legalized" "Gov't Being Evil" yadda, yadda, etc.

So I've this to say. And I think people should READ IT:

Instead, we recommended a framework whereby a legitimate orphan works owner who resurfaces may bring an action for “reasonable compensation” against a qualifying user. A user does not qualify for the benefits of orphan works legislation unless he first conducts a good faith, reasonably diligent (but unsuccessful) search for the copyright owner.

That said, we stress that statutory damages would not be off the table perpetually. If an owner were to emerge, his legal ownership of the copyright in his work is unchanged. Full remedies, including full statutory damages, would be available against new users and, indeed, against the original user making a new, subsequent use.

The “Orphan Works” Problem and Proposed Legislation


Keep in mind I am NOT agreeing with the bill, but people really need to stop screaming and actually do research.

In essence, all it says is that if someone wants to use a copyrighted piece of work and they can't find the original artist (and they DO HAVE TO TRY) they can use the work. Should said artist decide to show back up, the copyright is STILL in their name and they are entitled to compensation.

starfantazy is right, this looks more like journal material, but I see what you mean. I'm the type who tends to freak out the moment things seem to change for the worse, and you do not want to know what I did when I first found out. -_-'

However, although I am stupid and slow to learn, I do find out the reality of things and eventually wind back down. So yes, there seems to be nothing for me to worry about...

It is in my journal. Unfortunately, the entire community does not read my personal journal and in order to try and help with the calming process, it felt only right for this to be in the news. If this is strictly journal material, then so is over half the posts over this particular topic.

People in general need to look at a situation from all angles before coming to conclusions. This is merely just another side.

clearly i did. lol, are you a lawyer? then i doubt you have any more intelligence into interpreting the law than the rest of us. the issue is news, however, it has been in countless other articles, thus no need to make duplicate articles

By no means am I saying I have more intelligence with interpreting the law. If that is how you read my words then I highly suggest you not respond back.
And, if you will notice, this is NOT an article screaming about how art theft is being legalized. It is a different perspective which many people have not yet looked at. It is a duplicate subject; not a duplicate article.
