You cannot lose your copyright. Orphan is a temporary status. It's a bit hard to call some "MS Paint" fest Orphan when it obviously came from somewhere and usually recent. That's what our browsers have "internet history for"
As a person who uses an Orphan Work, they have to credit the fact that is IS an Orphan Work they're using. 2. They have to PAY when the owner shows up.
The person using an Orphan work is going to have to pay either way, when the owner of the copyright shows up. This is quite unlike Fair Use where the party who qualifies for it doesn't have to pay at all.
There are ALREADY Orphan works going on in Canada, do you see some "Bastard Canadians (sarcasm)" stealing our copyright? Of course not. They have to do pretty much what these bills are proposing.
The only difference is that there is a panel in Canada that reviews the case presented in using the works, and granting a "yay or nay" and the person has to leave a deposit in good faith to pay the owner in case he/she shows up.
The bills also say that they need to do a study on small claims for copyrights which actually opens up opportunities for us smaller end artists that may not be able to afford a lawyer to protect works that are already being infringed upon. That seems to be a step in the right direction for smaller end artists.
You still really couldn't sue anyways if you didn't register your copyright if someone infringed and you didn't do it within statute of the limitations to act upon and the party has since ceased doing the infringement. You didn't do it within a certain time frame within current law, in which Orphan doesn't apply to this, you're only liable for actual damages. You'd only hit "jackpot" if you had work that fell into registered and within the time frame.
It's a lot harder to go with Orphan Works since one of the bills says they have to advise or give notice that the work they're doing will be Orphan for commercial use.
Now the only people who may not have to pay are educational institutions, and I hardly see how for educational purposes someone's Fanart Yaoi of Naruto getting it on with another male character would fall into that.
