A in-depth look at the Orphan Works Bill, and to quote the article--
"The bills as presented ( S.2913 and H.R. 5889) are a photographer’s worst nightmare, and do much more harm than good. If you have not read them yourself, take the time to go through them, they may well become a dictator of your future. Despite the incredible damage that these bills will reap on the profession of photography, the house bill (and not the Senate version) has been strongly endorsed -- as-is --- by the ASMP and PPA - both of which I am a member of, and an active supporter of. These two leading organizations are charged with acting in the best interests of their professional photographer members. Apparently, these endorsements appear to have been made out of fear. Fear that no matter how horrible these bills might be for photographers, future bills may be worse. Sort of like jumping off of a cliff head first onto the rocks below, out of fear that you might one day slip and fall off of that cliff. Only in this instance, every photographer in the country will go over that cliff with them."

Good article, thanks for the link. As a UK citizen and an amateur artist I am obviously not affected in the way you and so many others are but y'know what they say: "where the US leads, the UK follows ...."

I've been following the recent spate of online discussions about Orphan Works with great interest, and my gut feeling is that the ';push' for this legislation (beyond that from legitimate beneficiaries such as museums) comes not from those who see profit in being able to use images with relative impunity, but from those who see great profits to be made in running the registries and search agencies which will crop up.

There are already "copyright registries" in existence in the UK, and we do not have the limitations on redress you have in the USA if work is not registered. Nor do we have the "mandatory deposit" requirement.

This is bad legislation and, if passed in more or less its current form, will set an awful example for the rest of the world.

This is worse than bad. This would be the end of online galleries and any market share photographers have because of them.

Any work can be stripped of its watermark and image metadata with enough time, effort, and tools.

I'm writing my Congressional representative and all the members of the Senate and House Judicial Commitee, and I encourage all concerned artists to do the same.

S 2913 at least has one of the clauses I'm looking for: "(iii) LACK OF IDENTIFYING INFORMATION- The fact that a particular copy or phonorecord lacks identifying information pertaining to the owner of the infringed copyright is not sufficient to meet the conditions under paragraph (1)(A)(i)(I)." These bills are still mostly unreadable as they're like patches to existing law. It's sorta like I'm trying to interpret a diff file for some programming source code.

I see no good coming from this legislation. It's a license to steal. People don't care now about stealing art and photography. This law protect the thieves and hurts artists and photographers. I'm not sure at this point how we can fight this, but there will be a fight.
