Gulfson.com Strikes Again

=Rebel2206:iconRebel2206: reports, May 6, 2008
==Taken From *Kiwanji's Forum Post==

So, all of you who work with resources on deviantART will probably know that a website by the name of "Gulfson" has been taking our own resources, and re-distributing them without credit or links. This is completely wrong, obviously. I found all 9 of my PSD's on there recently, and I even marked one of my latest with an anti-Gulfson logo. He still took them, and re-distributed them.

I was lucky enough to have a good friend find the email address of the owner of Gulfson. So, I had a chat with him. I won't display the chat log here, for certain reasons.

Anyway, I kindly asked him if he'd take our resources down.
He said he'd take mine down, but I refused and asked him to take all of the 100's of resources that dA's members own down, he then refused completely.
I tried to ask politely, but his cocky attitude has dug himself deeper.

So, plan of action:

Me and a kind helper, =Ayelie-stock (Any volunteers, go ahead, and note links to me please), are going to plough through the categories of Gulfson, and try and get as many of your resources linked back to you, so you can complain to the company who hosts this website. It's going to take a bit more than a day, I'd imagine, but I'll link as much of your stuff as I can in a news article or journal. It's then up to you if you want your resources back and this website shut down for good. There are plenty of things this man has done wrong; copyright infringement, re-distributing, not crediting, lack of permission, etc etc. I think any host would tolerate a website that's done so much bad.

If you want to keep updated on this, then look out for anything Gulfson related in dA's news in the next few days.

Now's your chance. If you're a .PSD, brush, pattern, style, texture, action, custom shape, or general resource artist, please consider this.

We so far have managed to
  • track down the host of gulfson.com which is KWSHELLS.com and can be found @ [link]

  • *celestiadevs has contacted KWShells about his/her artwork and has been able to speak to the owner of gulfson.com and i believe they have made some progress

Gallery Directors are volunteer positions and we do not represent the Company nor are we able to contact site's on the Company's behalf.

There was a massive rip of DA work on Photobucket a while back and the owners of the art were successful in getting the work removed by using this format:

DMCA Notice of Alleged Infringement ("Notice")

    1. Identify the copyrighted work that you claim has been infringed, or-if multiple copyrighted works are covered by this Notice-you may provide a representative list of the copyrighted works that you claim have been infringed.

    2. Identify the material or link you claim is infringing (or the subject of infringing activity) and that access to which is to be disabled, including at a minimum, if applicable, the URL of the link shown on the Photobucket website where such material may be found.

    3. Provide your mailing address, telephone number, and, if available, email address.

    4. Include both of the following statements in the body of the Notice:

    * "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as a fair use)."

    * "I hereby state that the information in this Notice is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed."

    5. Provide your full legal name and your electronic or physical signature.

I personally had work remove using this method.

However, I have heard people talking about this site and I'm not sure they are as responsive as Photobucket and other sites have been.

$realitysquared has written a few articles regarding rips and the need to protect your work with watermarks, but that obviously will not work with stock and resources.

There are sites that will not respond or take work down. It sucks, but I'm not sure what can be done about it. DA would need a team of lawyers to police the internet and that just isn't possible.

What I started to do with more recent stock submission is to zip up the files and put them in packs. It may deter some people because they are likely too lazy to download and unzip files. If we make it difficult for them to steal our work, perhaps they will go elsewhere.

I'm sorry if this isn't the action you expected, but there really isn't anything else I can offer.

Well the aim of informing Gallery Directors of this article and the site we could pass the message on to other stock/resorces artists so they could check to see if their work waqs on the site too.

But i understand the your positions are voluntry and its not your duty to go round policing the internet. But with the tight community DeviantART has we can slowly bring sites like this down or to agree to remove ripped/stolen/reproduced work that they don't have permission for.

Any help or just replying to this article is more than enough and thanks for getting back to me so soon

I'm glad you understand. :) I was not sure you knew how little we can do in terms of contacting them.

I know ^znow-white is aware of these folks too. They really, really agitate her as well.

What do you think about zipping up brushes, PSD file, textures, etc. ? Do you think it's too much trouble?

I'm really curious to see if these folks would take the time to unzip files.

Well I’m not really sure about zipping up resources as these are even more helpful to people ripping the artwork as

it can be put strait on to their servers without being extracted. but what you could do is when you zip up your work

You could put the site into a text file named 'READ ME!!'! in which you have allowed people to download from such as DeviantART ect. A sample of this would be

    "Resources (C) of [username]
you should only be able to download these files at the following addresses:
    [link] number]
    ect.

If you have downloaded theses files from else where they most probably don't have my permission to redistribute the files and therefore are not guaranteed to be safe and free of viruses.

If you have downloaded these files from else where please contact me with the link to where you have downloaded

    these files from.

    Kind Regards...."

I have seen one or two people using something similar to the above and I believe that this was successful.

So yeah, I see no gain in zipping your files.

But you could possibly password protect your files in a RAR archive, thus allowing you to choose where this password can be seen. I’ve seen this been used on many files hosted on servers such as megaupload.com and rapidshare.com

or both could work by stinging art/resource thefts into a trap where they have dead end files where their users cannot use or gain theses stocks because of the lack of the password to gain access to files.

Either way we can bring all this to a dead end slowly.
